To the extent that we obtain your consent to the processing of your personal data (e.g. in the framework of newsletter subscriptions), Art. 6 (1) sentence 1 lit. a) GDPR and Art. 6 (1) sentence 1 lit. c) GDPR serve as the legal basis for the processing and storage of this data. For all other processing operations in the context of the use of this website, Art. 6 (1) sentence 1 lit. f) GDPR serves as the legal basis. 3 ACCESS AND GENERAL USAGE OF THE WEBSITE 

3.1 LOG FILES

With every access of this website, our servers automatically store general access data about this process in server log files (“log files”).

We do not combine this data with other data sources. The temporary storage of the IP address in the log files is required for technical reasons and to ensure system security, in particular for detecting abuse. We delete the data as soon as it is no longer necessary to achieve the purpose for which it was collected. The IP addresses of users are deleted or shortened no later than 14 days afterwards.

In this case, we store a so-called "opt-out" cookie on your computer.  This opt-out cookie deletes the previously stored information and prevents the further capture of pseudonymised information.

We process the data as long as it is necessary to fulfil the purposes mentioned above. The data will subsequently be deleted.

Pseudonymous user profiles will be stored for a maximum of 24 months.

4 USE OF SPECIAL FEATURES OF THE WEBSITE

4.1 CONTACT FORM AND EMAIL CONTACT

On the website, we offer you a range of options for contacting us. If a contact form is provided on the website for general or specific requests or messages, you can use this to contact us by electronic means. Take advantage of this opportunity to enter the following data in the input screen:

  • Name
  • Email address
  • Message body
  • Any further information for specific requests or messages

Alternatively, you can send us an email.

The relevant data from the email or input mask will automatically be sent to the staff member at our company who is responsible for processing customer requests.

At the time of sending the contact form, your IP address and the date and time of the request is also automatically stored on our servers.

The processing of personal data in the input screen or email is used to handle your request.

 The other data collected (IP address etc.) during the dispatching process is used to prevent misuse of the contact form and to ensure the security of our information technology systems.

The personal data transmitted by you when you contact us will be stored for the duration of the respective conversation with you, and for no longer than 6 months after the end of the conversation, except when there are longer statutory retention periods in certain cases. The conversation will have ended when circumstances make it evident that the matter at hand has been conclusively resolved.

Personal data that was additionally collected during the dispatch procedure will be deleted at the latest after a period of 14 days. You have the option of withdrawing your consent to the processing of personal data at any time. To do this, please send an email to:  datenschutz@myphotobook.de. All personal data stored in the course of contacting us will be deleted immediately in this case.

5 ORDERING THE NEWSLETTER

You have the option of subscribing to our free newsletter on our website. The newsletter keeps you informed about the latest vouchers, discount codes or similar special offers for different product categories, such as fashion, travel or electronics in connection with offers that are published on our website. Your email address will only be disclosed to business partners if, at the time of the data collection, you expressly consented to also receive from those business partners newsletters about certain products and/or services.

5.1 DATA COLLECTION WHEN YOU SUBSCRIBE AND DOUBLE-OPT IN

When you subscribe to our newsletter, the personal data entered from the input mask is transmitted to us. Usually, you only need to enter your email address. In some cases, further information such as last name, first name and gender are requested.

 In addition, your IP address and the date and time of the request are automatically collected and stored on our servers.

If it is the first time you have subscribed to the newsletters, you will receive a confirmation email to the specified email address. This email confirmation contains a link that you must click on to confirm your registration. This so-called double opt-in procedure is used to check whether the holder of the email address has actually authorised, and agrees to, the receipt of this newsletter.

All subscription procedures are logged to satisfy the legal requirements for recording the subscription process. The record includes the subscription and time of confirmation as well as the relevant IP address.

5.2 USE OF E-MAIL DELIVERY SERVICE PROVIDERS

For shipping and evaluating our newsletter, we use the services of external service providers ("email delivery service providers"). Some of the email delivery service providers have their headquarters outside the EU/EEA. However, we work exclusively with companies that have an adequate level of protection for the data according to the provisions of the GDPR. For more information about the transfer to companies in third countries, see Clause 10.3.

We currently work with the following email delivery service providers:

  • “MailChimp”, a service of the company Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA .
  • ”Selligent”, a service of the company Selligent Marketing Cloud, Avenue de Finlande, 2 boite 2, 1420 Braine-l’Alleud - Belgium

The email addresses of the newsletter recipients and also any data described in the context of this Clause 5are stored on the servers of the email delivery service provider. Our email delivery service providers use the information collected on our account for dispatch and for evaluating use of the newsletter. Our email delivery service providers are in any case authorised to use the data of our newsletter subscribers in order to write to them themselves or pass the data on to third parties.


5.3 NEWSLETTER TRACKING

Insofar as you have agreed to this by registering for the newsletter, we can evaluate your use of the newsletter using tracking technology provided by the email delivery service provider. So-called web beacons or tracking pixels are embedded in the HTML emails sent with the newsletter. If the newsletter is opened, the external server of the email delivery service provider can use these web beacons to collect certain data about the recipient.

  The name of the image file will be individualised for each newsletter recipient by appending a unique ID to it. The mail sender uses this to remember which email address belongs to which ID, and by retrieving the image, can determine which newsletter recipient has opened the email.

The following data is collected via the tracking pixel when the email is opened:

  • Information about the browser and your system
  • Your IP address
  • Time and frequency of the opening of the email
  • Links clicked

We combine the data about your use of our newsletter with your other usage data that we have saved in the context of your general use of the website under a pseudonymous profile (see Clause 3.2).

 The data collected about you in the past is thereby pseudonymised. This summary entry helps us better understand your needs and preferences, so that we can optimally adapt the contents of the newsletter and our website to your personal interests.

 

The text of the declarations of consent, which you may have submitted when you registered for the newsletter, is listed at the end of this privacy policy.

5.4 STORAGE DURATION AND RIGHT OF WITHDRAWAL

The personal data processed within the framework of the order and the dispatch of the newsletter will be stored as long as the subscription to the newsletter is active. Ordering the newsletter and your consent to the processing of your data for the purposes stated above can be revoked at any time, either by using the link provided in the newsletter or by an email to: datenschutz@myphotobook.de.

Separate revocation with respect to the described tracking is not possible. However, you have the possibility of configuring your mail program so that emails are displayed in text form and not in HTML format. As a result, picture files and graphic files are hidden so that tracking is not possible. You can also prevent the use of web beacons by using the appropriate settings in your browser to prevent the installation of cookies.

Web beacons are used in conjunction with cookies.

In this case, the newsletter will not be displayed correctly and you may not be able to use all functions. 

6 INFORMATION ABOUT YOU THAT WE PROCESS

 

6.1 REGISTRATION AND CUSTOMER ACCOUNT

When you register with us, we use your data to create a customer account and to identify all data and orders with your person. Your customer account will remain active until you delete it or entrust us with the deletion.

 

6.2 PROCESSING YOUR ORDER

We use the data you have provided to fulfil your product order. Photo book data is deleted 60 days after shipment.

 

6.3 PAYMENT PROCESSING

After successful ordering and execution of an order, we will use the information you provide for invoicing. We will maintain the relevant order data and correspondence in accordance with the statutory retention periods, but for at least 7 years.

 

6.4 CUSTOMISED OFFERS

We use the data communicated by you and the history of your orders with our company to provide you with individual offers.

6.5 APPLICATION

When you apply via our online portal, we use the information that you provide exclusively for the application process. We will keep your application for up to a maximum of 6 months after rejection, unless we employ you.

8 INTEGRATION OF SOCIAL NETWORK PLUG-INS

We sometimes use on this website so-called social plug-ins ("plug-ins") of social networks and similar platforms in order to give you the option of quickly and easily sharing or recommending interesting deals in social networks, in order to make our company better known. Plug-ins are used to increase familiarity with our company. We consider the underlying advertising purpose to be in our legitimate interest within the meaning of Art. 6 (1) lit f) GDPR

You can identify the plug-ins used by the respective logo of the corresponding social network (e.g. a white "f" on a blue background for Facebook or and an “Instagram camera” for Instagram).

Embedding a plug-in in a web page usually has the consequence that when you access the website, your browser is establishes a direct connection to the servers of the respective provider and loads the appropriate plug-in as well as its contents into your browser loads, in order to integrate it into the website you visited. However, we have integrated the plug-ins in such a way that contact to the corresponding social network is only made if you actively interact with the plug-ins, for example, by clicking on the "Like" or the "Instagram" buttons and/or share content using the Share button. 9 USE OF THIRD-PARTY TECHNOLOGIES

We use third-party technologies within our website for analysis, optimisation and advertising purposes.

These third-party providers may collect data about your use of this website and your interactions with its content and functions, including the total number of visitors to this website, the referrer URL, the pages you visit, the date, time and duration of your visit, frequency, clicked on banner/links, as well as information about device type, browser version, language preferences and geographical location (including country, city, region). All information collected will be transmitted to and stored directly on the servers of the third party. The information will only be made available to us anonymously and in statistical form. We do not have access to data that will allow us to identify you.

9.1 PERFORMANCE OR WEB ANALYTICS TOOLS

We use all performance or web analytics tools only with activated IP anonymisation, so that the last three digits of the IP address will be erased immediately after collecting the data, and only the shortened IP address is stored on the servers of the respective third party.

9.1.1 GOOGLE ANALYTICS

Google Analytics is a web analytics service provided by Google Inc., Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google“). Google uses cookies to collect information about the use of our website by users. Google uses the data collected on our behalf to evaluate the use of our website, to compile reports about the activities on our website and to provide further services associated with the use of our website to us.

The information collected by Google about the use of this website (including the shortened IP address) is stored on Google's servers in the US.  Only in exceptional cases will the full IP address be transferred to a Google server in the USA and truncated there. The truncated IP address according to Google is not associated with any other data held by Google. Google automatically deletes from Google Analytics the stored user identifiers (e.g. cookie IDs) after 14 months.

(A) GOOGLE ADWORDS CONVERSION TRACKING

In the framework of the Google AdWords Conversion Tracking, a cookie is set on your computer ("Conversion Cookie") by Google when you click on a Google ad click and are redirected to this website. The conversion cookie enables us to identify whether and how many people who have accessed this website via an AdWords advertisement make use of our offers (e.g. a voucher code.

We use on the website pixels of the social network Facebook, which is operated for users from its headquarters in the EU from the Facebook Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland.

The pixels are integrated directly by Facebook when you access the website and they store a cookie on our users’ device.

 Facebook receives information from your browser that our site has been accessed from your device. 10 DISCLOSURE OF INFORMATION TO THIRD PARTIES

We will only disclose your personal data to third parties if this is necessary for the purpose of providing this products and  services, or we are contractually or legally obliged or authorised to do so, or if you have expressly consented to this.

We work with various suppliers (printers, postal services, photo optimizer), which produce the products offered in our online shop.

10.2 DISCLOSURE TO SERVICE PROVIDERS

We  also work with technical service providers, which, on the basis of Art. 28 GDPR are authorized to provide services on our behalf and in accordance with our instructions. These companies can gain access to your personal data, but only to the extent necessary to fulfil their respective tasks. So, for example, we employ service providers to send out our newsletter or other marketing services, to perform customer service, analytics or infrastructure and IT services as well as website hosting.

10.3 TRANSMISSION OF YOUR DATA TO COMPANIES OUTSIDE THE EU

It may happen that the service provider commissioned by us is in a third country, i.e. in countries outside the European Union (EU) / The European Economic Area (EEA).
